Terms of Service

Spark ("Spark", the "Service") is provided by AKOJ ("AKOJ", "we", "us", "our"). By creating an account or otherwise using Spark you ("you", the "User") enter into a binding agreement with AKOJ on these Terms.

By accessing or continuing to use Spark you agree to these Terms. If you do not agree, do not use the Service. If you are using Spark on behalf of an organization, you represent that you have authority to bind that organization.

Spark is an ADHD-friendly assistant that breaks tasks into small, doable steps using AI, voice input, timers, and personal rules. Spark is provided on an "as is" and "as available" basis; we do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated suggestions will be accurate, complete, or suitable for any particular purpose.

You must provide accurate information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must be of legal age in your jurisdiction to enter into this agreement.

You agree not to misuse Spark. In particular, you will not:

• Use the Service for any unlawful, fraudulent, abusive, or harmful purpose.
• Send spam, phishing content, or content that infringes the rights of others.
• Attempt to probe, scan, or test the vulnerability of the Service, breach security or authentication measures, or interfere with the Service (including via malware, scraping, or denial-of-service activity).
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restriction is prohibited by law.
• Resell, sublicense, or redistribute the Service or circumvent any technical limits.

Spark uses generative AI to suggest steps, prompts, and other outputs. You are responsible for your prompts, for how you use any output, for verifying accuracy before acting on it, and for ensuring you have the rights to any content you submit. Spark must not be used to generate illegal content, hate speech, deepfakes, malware, content that infringes intellectual property, or to attempt to jailbreak or extract the underlying models.

AI outputs may be inaccurate or incomplete and are not a substitute for professional advice (medical, legal, financial, mental health, or otherwise). We may filter, refuse, or remove outputs, and may restrict or suspend accounts that violate this section. If you believe content in Spark infringes your rights, contact us at hello@akoj.se; we may act on repeated infringement by terminating accounts.

You grant AKOJ a limited, non-exclusive license to host, store, and process the content you submit solely for the purpose of providing and improving the Service to you.

Spark, including its software, design, documentation, and branding, is owned by AKOJ and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use Spark within your chosen plan for the duration of your subscription. All rights not expressly granted are reserved.

Payments are processed by our payment provider Stripe. AKOJ is the merchant of record and is responsible for billing, subscription management, refunds, and customer support related to your order.

We may suspend or terminate your access to Spark, with or without notice, if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using Spark at any time by cancelling your subscription. On termination your right to use the Service ends; we may delete your data after a reasonable export window in accordance with our Privacy Notice.

To the fullest extent permitted by law, AKOJ disclaims all implied warranties, including merchantability and fitness for a particular purpose. AKOJ's aggregate liability for any claim arising from or relating to the Service is limited to the fees you paid to access Spark in the 12 months preceding the event giving rise to the claim. AKOJ is not liable for indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.

You agree to indemnify and hold harmless AKOJ from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

We may update these Terms from time to time. Material changes will be notified by email or in-app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Sweden, without regard to conflict-of-law rules. Disputes will be resolved by the competent courts of Sweden, except where mandatory consumer protection law grants you the right to bring a claim in your country of residence.
